The PM Dr.MMS has lamented in Lok Sabha that frequent disruption of parliamentary proceedings is a cause for(foreign) investors losing confidence.

I am not sure whether Dr.Singh’s presumption is true.

Market sentiments do count but parliamentary walk-outs and shouting matches in the well of the house do not form a part of those sentiments. FM’s finance-talk or RBI directives do impact the market. The investment space is a vacuum without any trace of humanity.

In my narrow exposure to investment banking, I have observed Sensex soaring merrily while a huge Tsunami hit Tamilnadu coast resulting in heavy loss of life. In fact when the whole Tamilnadu was mourning the tragedy, only two happenings oblivious to the surroundings were going on – the December Katcheri season and brisk bourse trading in Chennai and the rest of India.

Having said this, I agree with the PM on one count – we have the worst opposition. Session after session gets disrupted and comes to a close without any meaningful proceedings taking place. An unresponsive Government would get only such an irresponsible opposition.

(d) applies his mouth to the vagina, anus, urethra of a woman or makes her to do so with him or any other person, under the circumstances falling under any of the following seven descriptions:—

First.—Against her will.

Secondly.—Without her consent.

Thirdly.—With her consent, when her consent has been obtained by putting her or any person in whom she is interested, in fear of death or of hurt.

Fourthly.—With her consent, when the man knows that he is not her husband and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married.

Fifthly.—With her consent when, at the time of giving such consent, by reason of unsoundness of mind or intoxication or the administration by him personally or through another of any stupefying or unwholesome substance, she is unable to understand the nature and consequences of that to which she gives consent.

Sixthly.—With or without her consent, when she is under eighteen years of age.

Seventhly.—When she is unable to communicate consent.

EraMurukan Ramasami more than that, I am unable to comprehend the usage – ‘consensual sex with minor’. Even Contract Act declares any contract entered into with a minor null and void.

Prabhuram Ramachandran Legal system was the last pillar of hope and many a times they did a wonderful job. But, recent times we witness more and more judgements that are pronounced with the aim of making news than any real solution. This one appears to be for the same purpose.

Ananthakrishnan Pakshirajan Unless one reads the entire judgement and its context, it is difficult to comment on this. I am of the view that POCSO Act is flawed – like most of the acts that had been passed in this land are. It doesn’t take care of the rural reality of India, especially North India. In many communities, a girl is married off when she turns 15. In Delhi, the lady who is ironing our cloths has just performed the marriage of her grand daughter who has turned 15. It has been calculated that around 39000 child marriages happen everyday in India, which means that one out of every two marriages is a child marriage. Every such marriage is against the law of the land. Thus, there is no legal solution to this practice. Education and especially woman’s education is the only answer.

Simmam Raghu i agree with Mr. Ananthkrishnan. The human body is kindled with hormones even at tender ages and the girls who attain puberty and who are unable to control their sexual urge due to their growing etc., are more prone to this experience. The worst part of it is that they are lured by men who try to exploit this hapless girls. They make some false promises and take advantage of them. Unless an awakening is spread through education, this menace could not be controlled.

Kalyan Kumar I believe more and more acts which used to be monitores thru family system of values and traditions are being slowly given away to judiciary for control.This is the starting point of all trouble. Inculcation of discipline and values is the first step that would go a long way to avert these ,Judiciary can not be blamed as they ggo by circumstantial evidences of the case and the pressures of the society at a given point of time.

Lakshmi Chitoor Subramaniam There are many things involved here. In the first place there are child marriages taking place. I have come back from Rajasthan a few months ago where a mass child marriage took place and the police could do nothing. And secondly and more importantly, teenage girls who are minors have begun to take decisions regarding their bodies in big cities like Mumbai. The question the sessions judge has rightly asked is whether we leave the decision of the bodies of the girls entirely in the hands of the police. A minor girl, even if she has physical needs may not be mature enough to deal with her body. The question is do we tell her this through education and creating awareness or do we just criminalise all sexual decisions taken by her? Banning sex with a minor girl per se will not provide a solution. I think each case has to be dealt with on its own merit.

Satyanarayana Athmuri t is very disturbing. What does this imply – If a girl (below 18) consents for “sex outside marriage” it is legal. But if the same girl “consents for marriage – and have sex” it is illegal. Very weird.

Sampath Sowrirajan The question of “minor” really rankles. If such an observbation was made in court it goes against “sixthly in Mouli’s list, leaving no room for interpretation. Furthermore, mouli’s list does not include “மாமா சாக்லேட் கொடுத்தா !”

If at all what he did was true and if at all he is on verge of getting trapped, he will pay money to the parents of the 15 year old girl, threaten them with take it or leave it, and force them to make it sound consensual. We will be back to the good old panchayat days!

Ananthakrishnan Pakshirajan Oh, no. We are reading too much into this. As I said earlier 50% of the marriages in India are between a girl less than 18 years old and probably an adult male. Asaram Bapu and others hog the news but they are not part of the real story.they will keep doing what they are doing, whatever be the law. We are trivialising the problem by making it sound sensational.

Ananthakrishnan Pakshirajan No. Firstly lower court judgments will not be setting precedence. Secondly the issue is more complex than the case under discussion. By quoting sensational cases we are only distorting the issue. There is no point getting indignant. Unfortunately, the Indian rural sensibilities happen to be different from the urban ones.

The prosecution case is pocso act.The complaint is girl missing accused victim version marriage between 22 m and 15 female living together as husband and wife. Under hindu law though marriage below 18 for girl and 21 for boy is forbidden by prnciples of factum valet under customary Hindu law it is not treated as void. There is no complaint of abduction or petition for custody by mother.she also said to have accepted. Consent is immaterial under ipc 375 or 376 even with cons
ent it is rape if the girl is below 16. However there is no prosecution under ipc alleging rape. The answer is if prosecution is also under s376 ipc the pocso act alone has no bar to proceed under ipc in strict letters of law. But if you bring in mensrea guily mind and customary law of approving young age marriage the allegation of rape and statement of reporting it is not a rape will not cause concern. The law to be applied secure the girl and give it to custody of mother until 18 there after permit them to live as Husband and wife

None the less, I still wonder what is the locus standi of POCSO if it is in contradiction with IPC even to a smaller extent (is ‘ultra vires’ the right term?)

Kalyanam Vijayan There is no terminology of ultravires when we examine cognate act. In criminal law an act or omission may attract more than one act. If so every such act can be independently proceeded with. S34 of pocso act enables that. In that case there was no charge sheet at all under IPC. Our sense of emotion may justify so many acts, but law functions compartmentally. There is no Amirthanjan kind of sarva nivarani in law. Era mu as a writer certainly have sesitivity on many social issues without any limits. But does not function in that way. You need a diff mind set to understand the functioning of law.

Kalyanam Vijayan An act can be ultravires only to constitutional law if the act is challenged on the touchstone of constitutional law. When two acts are compared we call it inconsistant with other law. So ultravires term is used only when we test the constitutionality of it.

Kalyanam Vijayan Ultravires means beyond the powers. Under our legal system constitution is the supreme law. All laws are subject to constitutioal restriction. We have classification like central law where parliament alone pass law state law where state assemly alone can pass law and in some case cocurrently both cenre and state can pass law. Say suppose income tax which is the exclusive domain of centre, if a state pass a law on income tax we call it ultrvires to constitution. So if a law is passed against contitutional restriction we call it ultr vires (beyond the powers)

Kalyanam Vijayan If protection of children from sexual harressment Act which is a special law is in variance with general law IPC we dont call it ultravires to IPC. Because it is made within the powers. We say it is inconsistant. Normally court will not intrepret two acts which are inconsistant. They apply a rule of harmonius construction. To save both. Or they will read down the act.

This logically follows that consent by the minor is invalid and …..Murug…. now there are so many news items which say that rape incidents should be severely dealt with! as though it is allowed in the past. Rape should always be severely dealth with. Why suddenly people are talking about it now? Laws are stringent but not maintained

Lakshmi Chitoor Subramaniam Vasantha Kumar, you are right but we are in a situation where younger girls are taking decisions about their bodies. The question is how does one deal with this? Do we criminalise it like child marriages which take place in any case despite stringent laws. It is not just a question of rape but also a question of sexual practices and mores of behaviour.
